HR3322 - Tobacco and E-Cigarette Use on College Property Procedure
Section: GENERAL INFORMATION
I. Institutional Regulations
The College is committed to providing a safe and healthy environment for its employees, students and visitors. In compliance with Iowa Code Chapter 142D, the Smoke-Free Air Act, and findings of the U.S. Surgeon General that use of tobacco is a contributing factor to significant health hazards, it is the intent of the College to establish a tobacco free environment. No consumption of tobacco is allowed on any college property or in any college facility; this includes all buildings, grounds, sidewalks and streets within the campus proper. The College will display notice of its tobacco-free policy at all college locations.
II. Procedure
- For the purpose of this policy, “tobacco” is defined to include all lit or unlit cigarettes, cigars, pipes, bidis, clove cigarettes, and all other smoking products; smokeless or spit tobaccos, also known as dip, chew, snuff or snus, vapors, and e-cigarettes in any form.
- Faculty and staff who do not comply with the this procedure and related College policy will be issued fines in compliance with Iowa Code 142D and/or will be subject to DMACC disciplinary action.
- Supervisors of employees who do not comply with this procedure and related College policy shall follow progressive discipline as outlined in HR 3235, beginning with a verbal warning.
- Faculty and staff members who witness a student violating this procedure or related College policy should follow the related Student Services guidelines for student compliance.
- Faculty and staff members who witness employees violating this policy should follow the following guidelines:
- Provide the violator with a courteous reminder of DMACC’s policy.
- Contact the individual’s supervisor if:
- You are not comfortable reminding the violator about the policy and wish to report the violation,
- The violator is a frequent offender.
- The violator is rude, discourteous, or defiant.
- Employees who witness visitors or contractors violating this policy should provide the violator with a courteous reminder of DMACC’s policy.
- Harassment or intimidation of violators or those reporting violations is not allowed and is subject to DMACC disciplinary policy.
- The College provides reasonable assistance to any employee who seeks information regarding tobacco use, including counseling, treatment or rehabilitation programs.
